Book & Branches Pty Ltd – Terms & Conditions

In these Terms, “we”, “us”, and “our” refer to Book & Branches Pty Ltd, and “you” refers to the client, participant, or website user.
These Terms & Conditions apply to all services and activities provided by Book & Branches Pty Ltd, including Bush Kindy Learning (professional development), Bush Kindy Teaching (children’s programs), Bush Kindy Shop (products and resources), and digital tools such as reflection forms or AI-supported learning prompts.
1. Enrolment and Participation
Participants must be over 18 to register for any Bush Kindy Learning or Bush Kindy Shop service. For Bush Kindy Teaching (children’s programs), parents or legal guardians must complete the registration on behalf of any participating child.
By registering or participating in any of our programs or services, you confirm that you are legally authorised to do so and agree to abide by these Terms. You acknowledge that participation may involve outdoor activity and interaction with natural elements. Where children are involved, you accept full responsibility for their supervision unless otherwise stated in writing.2. Changes, Cancellations and Refunds
We may cancel or modify sessions at our discretion due to weather, illness, safety concerns, staff availability, or other unforeseen circumstances.
For paid programs or services:
Professional development bookings cancelled within 7 days may incur a 50% cancellation fee.
Custom sessions or workshops are non-refundable once confirmed.
Digital product sales are final.
Refunds are not provided for change of mind or failure to attend.
For free Bush Kindy Teaching sessions:
Places are limited. If you are no longer able to attend, you must cancel at least 48 hours in advance.
Repeated no-shows may result in restricted access to future free sessions.
Cancellations due to extreme weather:
Programs may be cancelled or modified at the discretion of Bush Kindy Teaching due to severe weather conditions such as thunderstorms, high winds, or extreme heat.
If a session is cancelled, participants will be notified via SMS or email as soon as practicable.
A replacement session will be offered where possible.
Rescheduling:
If either party requests a reschedule, we will make reasonable efforts to accommodate. Training may only be rescheduled once per booking unless otherwise agreed.
Belongings:
Participants are responsible for their own belongings. We do not accept liability for lost, damaged, or stolen personal items.
3. Assumption of Risk
You acknowledge that participation in nature-based or outdoor learning programs involves inherent risks, including but not limited to: slips, trips, allergic reactions, insect bites, interactions with animals or plants, or exposure to weather extremes. You assume full responsibility for any injuries, losses, or damages arising from your or your child’s participation, except where otherwise required by law.
4. Medical and Emergency Situations
You must inform us in advance of any relevant medical conditions, allergies, or access needs. Parents/caregivers must ensure their emergency contact and next of kin details are current and accurate at the time of registration or arrival.
In the event of a medical emergency:
We will administer basic first aid if required.
Emergency services will be contacted if deemed necessary.
We will attempt to contact your nominated emergency contact as soon as practicable.
You are responsible for all costs associated with emergency care not covered by our insurance.

Photographs and video may be taken during our sessions or programs for promotional or documentation purposes.
You may opt out at any time by notifying us in writing or on arrival at the session.
Where children’s images are used, written consent will be obtained from a parent or legal guardian.
You may withdraw consent at any time by contacting us.
7. Reflection Tools and Digital Prompts
By using these tools, you acknowledge:
Participation is voluntary
Reflections may be used to support your learning or to guide facilitator support
No data about children is collected through these tools
Any information you provide is handled in line with our Privacy Policy
You may request to view or delete your submission at any time by contacting us.
8. Smoking and Alcohol
Smoking, vaping, and consumption of alcohol are strictly prohibited during any program, training or session.
9. Products and Returns (Bush Kindy Shop)
This policy does not limit your rights under Australian Consumer Law. You are entitled to a refund or replacement if a product is faulty, not as described, or unfit for purpose.
Products are designed for educational use and must be used under adult supervision.
Returns are accepted for faulty or damaged products only. You must notify us within 48 hours of delivery for transit damage and within 14 days for product faults.
Change of mind returns are not accepted.

Payments must be made by the due date on your invoice.
Overdue payments may result in cancellation of services or suspension of access.

12. Limitation of Liability
To the maximum extent permitted by law:
a) Book & Branches Pty Ltd (including its directors, employees, agents, and contractors) shall not be liable for any indirect, incidental, consequential, or punitive damages arising from participation in any of our programs, services, or use of products.
b) Our total liability for direct damages shall not exceed the amount paid by you for the relevant service or product.
c) These limitations do not apply to liability arising from gross negligence or wilful misconduct or where such liability cannot be excluded by law.
d) You acknowledge that nature-based learning and outdoor programs involve inherent risks, and you accept full responsibility for any injuries or damages that may result.
13. Indemnification
You agree to indemnify and hold harmless Book & Branches Pty Ltd, its directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or legal fees arising from:
Your breach of these Terms
Your or your child’s participation in a program
Any negligent or intentional act or omission by you or your child

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in Brisbane jurisdiction.
17. Amendments
We reserve the right to modify these Terms & Conditions at any time.
Continued participation in our services constitutes acceptance of any updated Terms.
By accessing, registering for, or participating in any service, session, product, or training offered by Book & Branches Pty Ltd (including Bush Kindy Learning, Bush Kindy Teaching, or Bush Kindy Shop), you acknowledge that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy.
